Kenya enacted its Data Protection Act 2019 (“DPA”) on 25th November 2019, thereby creating a wide-ranging set of new legal obligations for business organizations with respect to personal data which they collect from customers, employees and third-party suppliers and service providers in Kenya. The DPA provides a legal framework to the right to privacy, which is a fundamental right under Article 31 of the Constitution of Kenya. The DPA is substantially modeled on the European Union’s General Data Protection Regulation (“GDPR”), which is currently the leading global benchmark privacy legislation.
